We are an electronic commerce platform that offers the sale of products and services related to the aeronautical and aviation area, through digital sales.

By purchasing products and/or services through eShop.Aero, you accept on your behalf and on behalf of those who purchase our products and/or services through your account, the following terms and conditions:

 

  1. Parties: These terms and conditions regulate the relationship between eShop.Aero, its related companies and those who use its services, who are hereinafter referred to as will name "users".

  2.  Account: In order to operate on the platform, all users must create a user account and accept the Terms and Conditions, and in the appropriate cases, they must also sign annexes, contracts and/or additional declarations.

    Users who have no pending obligations with eShop.Aero may cancel their account at any time. In the cases in which the execution of a contract or the signing of annexed documents is mandatory, the cancellation or termination will be regulated by the norms indicated in the latter.
    Each user must provide accurate and authentic data and will be responsible for the personal data provided at the time of registration, which must be kept updated. EShop.Aero and its associated companies will not be responsible for any damages that may be generated due to the erroneous information that is entered in the user's account. Each user will be solely responsible for the use of their account, the protection of their password and the associated means of payment.
    EShop. Aero reserves the right to request and/or consult additional information to corroborate the user's identity.

  3.  Account restrictions
    * Each user will only be able to access an individual account.
    * To create an account and access our services, users must be of legal age and have the  legal capacity to hire.
    * If the account belongs to a company, it must prove its legal representation.
     * Eshop.Aero and/or its related companies reserve the right to refuse to open an account or cancel any account at any time.
    * The opening of accounts to persons or companies that have state or government restrictions is prohibited.
  4. Sanctions: In the event that the user breaches a law or the Terms and Conditions, we may warn, suspend, restrict or temporarily or permanently disable your account, without prejudice to other sanctions established by applicable legislation.

  5.  Prices: Prices for products and services are subject to change without notice. In all cases, the invoice will be issued in accordance with the data that users have in their accounts.  We reserve the right to correct any error, inaccuracy, omission or update in product prices, which may be modified at any time without prior notice.

  6. Annexes: Due to the nature of the services offered in eShop.Aero, some of its products and services require the signing of contracts and/or other additional annexes to the terms and conditions established herein. In these cases, these terms and conditions will be considered an integral part of those for all legal purposes.

  7. Use of our store: Our store is for personal and commercial use only. The use of this site for illegal or not expressly authorized purposes is prohibited. Unauthorized use or use outside the legal framework may lead to the relevant legal sanctions.

  8. Intellectual property: All content and materials in our store, including, but not limited to, text, images, graphics, logos, and software, among others, are the property of our store or its content providers and/or associated or related companies, and are protected by the United States and international copyright laws. You may not reproduce, distribute, modify or create derivative works of any content or material in our store without our prior written permission.

  9. Characteristics and Technical Information of Products: We will deliver product information in accordance with the technical specifications and characteristics provided by the manufacturer itself. Therefore, in certain cases this information could only be referential, eShop.Aero is not responsible for differences between the information provided and the final product. However, it provides the option to make the return in accordance with our return and refund policy in case you are not satisfied with the product received.

  10. Currency: All prices will be published and payments must be made in US dollars.

  11. Payments: By placing an order for a product or service through our store, you agree to provide accurate and complete information regarding your payment information. You also authorize us to charge your payment method for the full amount of your order, including any applicable taxes, shipping fees, and other related costs that may apply. We reserve the right to refuse or cancel any order for any reason, including, but not limited to, product unavailability, errors in pricing or product information, suspicion of fraud or abuse, or any payment method issue.

  12. Limit of Liability:  Except for legal provisions to the contrary, our store and its owners, employees, affiliates and agents are not liable for any direct, indirect, incidental, special or consequential damages arising out of or in connection with your use of our store or its associated or related companies.

  13. Responsibility and Compensation:  You assume responsibility for misuse or breach of these Terms and Conditions or the normative applicable law and eventually in case of non-compliance may be responsible for carrying out compensations, withholdings or other measures necessary for the repair  of losses, damage and damages whatever their nature, agreeing to indemnify in the cases provided by law and also exempts our store and its owners, employees, affiliates and agents from liability, as well as its related or associated companies, and those who direct them, succeed, manage, represent and/or work for them, from any administrative or judicial claim, damage, loss, liability, cost and expense (including reasonable attorneys' fees) arising out of or in connection with the use of our store, the violation of these Terms and Conditions and/or the violation of any right of a third party, which is directly or indirectly related to the use of this store.

  14. Jurisdiction: These Terms and Conditions are governed by the current and local law of the State of California in the United States of America. Any controversy derived from this agreement or its related contracts or documents will be resolved by the competent courts of justice.

  15. Modification of Terms and Conditions: We reserve the right to modify these Terms and Conditions at any time without prior notice. Your continued use of our store after such changes constitutes your acceptance of the new Terms and Conditions.

  16. Order Cancellations: If you need to cancel your order, please contact us as soon as possible. We will do our best to accommodate your request, but please note that we may not be able to cancel if your order has already been processed and/or shipped. In these cases, the reimbursement procedure will be applicable.

  17. Intellectual Property: Eshop.Aero and/or its related companies own all intellectual property rights over their sites, all their content, services, products, brands, trade names, logos, designs, images, copyrights, domains, computer programs, codes, developments, software, databases, information, technology, patents and utility models, industrial designs and models, trade secrets, among others.
    It is prohibited to use our products or services for illegal purposes, use or extract data and content from our platform for use or reproduction, or create your own databases that include all or part of our content, without our express authorization. It is also prohibited to use it contrary to current regulations and/or that causes harm, damage or loss to Eshop.Aero or its related companies. The use of eShop's products and services does not imply authorization to use the intellectual property of third parties that may be involved, the use of which will be under the sole responsibility of the user.
